Who needs Garda Vetting in an Irish sports club?

How Irish sports clubs should assess roles for Garda Vetting, with links to legislation and governing-body guidance.

Short answer: the legal test turns on the work or activity, not simply a person's title. Section 12 of the 2012 Act restricts relevant organisations from permitting a person to undertake relevant work or activities without first receiving a vetting disclosure.

Start with the role

The Data Protection Commission summarises the core position as applying where a necessary and regular part of the work or activity consists of access to, or contact with, children or vulnerable adults. A club should map what each role actually involves and then follow its NGB's rules.

Coaches, managers and trainers of underage teams are common examples, but a job title alone is not a complete assessment. Frequency, duties and the nature of contact matter. The National Vetting Bureau FAQ also discusses an exclusion for certain occasional assistance, while making clear that coaching, mentoring, counselling, teaching or training is treated differently. Clubs should not turn that into a blanket exemption.

Governing-body rules may be more specific

The GAA states that people coaching, managing or training underage teams, organising underage activities or refereeing underage games must be vetted through its process. The FAI requires its own vetting before a person starts a position working with children or vulnerable persons. A rugby club should follow current IRFU and Branch guidance.
